In light of the increasing attacks and violations targeting Tunisian lawyers, it is crucial to highlight the obstacles and intimidation they face , both in the exercise of their duties and in their political and activist engagements.
From the Ben Ali regime to the present day, the legal profession in Tunisia has played an essential role.
However, in recent years, lawyers have become the victims of numerous attacks restricting their freedom to practice.
Through a Policy Brief, Avocat Sans Frontières (ASF) proposes key recommendations to preserve their independence in a context of autocratif transition. These include:
- Ending abusive prosecutions against lawyers
- Putting an end to intimidation and violence against lawyers
- Amending Articles 8, 6 and 5 of the Military Justice Code
- Respecting the Basic Principles on the role of lawyers
- Preserving the legal immunity of lawyers
ASF is calling for urgent action to strengthen the protection of lawyers in Tunisia. The proposed measures aim to guarantee their fundamental rights and create a favourable environment for legal defence, free from interference and reprisals.
By adopting these measures, Tunisia will reinforce the rule of law, facilitate access to justice, and protect human rights.
