{"id":1500,"date":"2024-12-18T10:20:42","date_gmt":"2024-12-18T09:20:42","guid":{"rendered":"https:\/\/justiceexpeerience.org\/?p=1500"},"modified":"2024-12-18T10:20:42","modified_gmt":"2024-12-18T09:20:42","slug":"obligations-des-etats-en-matiere-de-changement-climatique-audiences-historiques-a-la-cij","status":"publish","type":"post","link":"https:\/\/justiceexpeerience.org\/en\/2024\/12\/18\/obligations-des-etats-en-matiere-de-changement-climatique-audiences-historiques-a-la-cij\/","title":{"rendered":"State Obligations on Climate Change: Historic Hearings at the ICJ\u00a0"},"content":{"rendered":"<p class=\"has-text-align-justify wp-block-paragraph\">On March 29, 2023, the UN General Assembly adopted a resolution requesting the ICJ to&nbsp;<a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/187\/187-20230630-req-01-00-fr.pdf\">issue an advisory opinion<\/a>&nbsp;on two key options:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What are the obligations of States under international law to ensure the protection of the climate system from greenhouse gas emissions for present and future generations?<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What are the legal consequences of these obligations for States that cause significant damage to the climate system, particularly concerning small island developing states and present and future generations affected by the adverse effects of climate change?<\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">This resolution, initiated by Vanuatu in 2021, marks a historic turning point for international law and the fight against climate change. Following the disappointment of COP29 in Baku, where commitments were\u00a0<a href=\"https:\/\/climatenetwork.org\/2024\/11\/23\/cop29_betrayal_in_baku\/\">deemed insufficient<\/a>\u00a0by many Global South countries, the<strong>\u00a0recourse to the ICJ is seen as the only way to obtain legal calrity on States obligations<\/strong>\u00a0regarding climate protection.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">This process is\u00a0<strong>exceptional, with a record participation of 97 States and eleven international organizations in the hearings<\/strong>.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">The hearings, held from December 3 to 13, 2024, represent a\u00a0<strong>unique opportunity for vulnerable nations<\/strong>, especially small island states<strong>, to establish a stronger framework of accountability for addressing the impacts of climate change<\/strong>.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Although the ICJ\u2019s advisory opinion is\u00a0<a href=\"https:\/\/www.icj-cij.org\/fr\/competence-en-matiere-consultative#:~:text=Il%20appartient%20aux%20institutions%20ou,qu'une%20grande%20autorit%C3%A9%20morale.\">not legally binding<\/a>, it holds\u00a0<strong>a significant legal value<\/strong>\u00a0and\u00a0<strong>substantial moral authority<\/strong>, which can i<strong>nfluence national and international decision-making, guide State action<\/strong>\u00a0and\u00a0<strong>illuminate future climate-related litigation<\/strong>. The aim is to develop legal obligations beyond the framework of the Paris Agreement, which has been widely\u00a0<a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/187\/187-20241202-ora-01-00-bi.pdf\">criticised<\/a>.
