On 2 December, the Belgian courts marked\u00a0a major turning point <\/strong>by finding the\u00a0Belgian state guilty of crimes against humanity for the treatment inflicted on mixed-race children under colonial-rule<\/strong><\/a>.\u00a0<\/strong>Five mixed-race women, born to a black mother and a white father in the former Belgian Congo (now the Democratic Republic of Congo), won an appeal against the Belgian state.<\/p>\n\n\n\n

Simone Ngalula, Monique Bitu Bingi, L\u00e9a Tavares Mujinga, Noelle Verbeeken and Marie-Jos\u00e9 Loshi denounced inhumane acts, including\u00a0their forced abduction from their mothers, their placement in religious institutions<\/strong>, within a system of racial segregation, and their\u00a0abandonment to their fate at the time of the country's independence.<\/strong><\/p>\n\n\n\n

The plaintiffs' case was dismissed in\u00a02021<\/strong>, but they have appealed with the support of a team of lawyers and human rights activists. The recent ruling by the Brussels Court of Appeal found that these\u00a0practices constitued crimes against humanity:\u00a0<\/strong>\"\u00a0They were taken from their respective mothers without their consent, before the age of seven, by the Belgian State in execution of a plan for the systematic search for and abduction of children born to a black mother and a white father, raised by their mother in the Belgian Congo, only\u00a0because of their origins.<\/strong><\/em>\u00a0\"<\/p>\n\n\n\n

The five women will receive\u00a050,000 euros in compensation<\/strong>, a symbolic amount given the harm they suffered. The Court of Appeal's decision\u00a0is not only limited to individual recognition<\/strong>\u00a0for the five plaintiffs. It sets an\u00a0important precedent in Belgium and Europe in terms of state responsibility for colonial crimes\u00a0<\/strong>and\u00a0fight against impunity.<\/strong><\/p>\n\n\n\n
