In a report published on December 5, 2024, Amnesty International<\/a>  asserts that Israeli authorities are committing genocide against the Palestinian population in Gaza<\/strong>. By documenting systematic deprivations of food, water, and healthcare, along with the mass destruction of Gaza and its inhabitants, the report draws a direct link between these actions and a deliberate policy originating from the highest levels of the Israeli state.<\/p>\n\n\n\n

Amnesty highlights a troubling convergence between the statements of Israeli officials<\/strong>, marked by explicit dehumanisation<\/strong> of Palestinians, and videos of soldiers echoing genocidal chants on the ground.<\/p>\n\n\n\n

Amnesty's report builds on a series of documents and declarations issued by international bodies. As early as March 2024, the UN Special Rapporteur on human rights in the occupied territories indicated <\/a>reasonable grounds to believe that acts of genocide had been committed.<\/p>\n\n\n\n

In November 2023, the FIDH adopted a resolution denouncing an ongoing genocide. That same month, UN Special Rapporteurs called on the international community<\/a> to act urgently to prevent genocide, emphasizing the severity of the situation. Subsequently, the ICJ also addressed the plausibility of such acts in its provisional<\/a> <\/a>measures<\/a> <\/a>order<\/a> in the case brought by South Africa against Israel.<\/p>\n\n\n\n

The qualification of genocide carries significant political and legal consequences<\/strong>. Its imposes a legal obligation on all states to prevent such acts<\/strong>, including prohibiting any form of assistance and implementing active measures to halt the continuation of genocidal actions, as emphasized in the ICJ's advisory opinion<\/a> in July 2024.<\/p>\n\n\n\n

On the judicial level, the ICC Prosecutor's office could rely on Amnesty's evidence to issue new arrest warrants<\/strong>, while the ICJ could use these reports as credible evidence to establish facts and demonstrate state intent, particularly in the case brought by South Africa against Israel.<\/a>.<\/p>\n\n\n\n

Furthermore, this report could help break the taboo surrounding the use of the terme 'genocide\"<\/strong>, fostering a significant shift in legal and political discourse, similar to the ICJ's 2024 recognition of apartheid.<\/p>\n\n\n\n

Finally, it serves as a counterweight and a form of political pressure<\/strong> in the face of potential U.S. sanctions targeting the ICC<\/a>\u00a0and those collaborating with it, highlighting the growing tensions between international justice and certain state actors.<\/p>\n\n\n\n
