On September 2,\u00a0129 detainees lost their lives in Makala Prison<\/strong>\u00a0during tragic events that remain difficult to qualify. Amid this chaotic event,\u00a0268 out of 298 women incarcerated in Makala were victims of rape.<\/strong>.<\/p>\n\n\n\n

In this Policy Brief, ASF highlights that these events occur within a broader context of massive human rights violations against detainees, the abusive use of pretrial detention<\/strong> and endemic prison overcrowding.<\/strong> The systematic and illegal use of pretrial detention and the resulting inequality in criminal proceedings are key factors contributing to the prison crisis in the DRC.<\/strong>.<\/p>\n\n\n\n

Since 2021, ASF and its partners\u00a0have been documenting and analysing human rights violations\u00a0<\/strong>experienced by detainees through a\u00a0monitoring system,\u00a0<\/strong>based on interviews with\u00a03,642 pretrial detainees<\/strong>\u00a0and nearly\u00a020 years of experience<\/strong>\u00a0in the DRC.<\/p>\n\n\n\n

According to detention observers in the DRC, pretrial detainees account for\u00a070-80% of the prison population<\/strong>, a phenomenon that seems to worsen over time.<\/p>\n\n\n\n

In 10% <\/strong>of cases, detainees are unaware of the charges<\/strong> against them. ASF's analysis reveals that exceeding legal deadlines has become a standard practice, making illegality the norm in pretrial detention.<\/strong><\/p>\n\n\n\n

A series of\u00a0recommendations aim to provide practical solutions\u00a0<\/strong>en vue de\u00a0<\/strong>to ensure a detention system that respects human rights and complies with international standards.<\/p>\n\n\n\n
