These decisions, often deemed unconstitutional, have faced <strong><a href=\"https:\/\/www.washingtonpost.com\/politics\/2025\/02\/10\/trump-judges-vance-musk-defy-orders\/\" target=\"_blank\" rel=\"noreferrer noopener\">growing opposition<\/a> from the judiciary power.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Between 23 January and 13 February, 2025,<strong> several federal judges canceled, suspended, or blocked <a href=\"https:\/\/www.huffingtonpost.fr\/international\/video\/ces-decrets-de-donald-trump-sont-deja-deboutes-ou-suspendus-par-la-justice-americaine_245899.html\" target=\"_blank\" rel=\"noreferrer noopener\">a number of orders.<\/a>.\u00a0<\/strong>One of the most significant cases involved <a href=\"https:\/\/www.citizen.org\/wp-content\/uploads\/ECF-30-Amended-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">the freezing of US foreign aid<\/a>.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">On 13 February, <a href=\"https:\/\/s3.documentcloud.org\/documents\/25535268\/aliorder.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">a federal judge from Washington<\/a> prevented the administration from implementing an executive order signed by Donald Trump on the day of his inauguration, which halted almost all funds allocated to development aid. In his <a href=\"https:\/\/s3.documentcloud.org\/documents\/25535268\/aliorder.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a>, the judge stated that the presidential measure was \"<em>based on <strong>dubious logic<\/strong> and causes <strong>considerable harm<\/strong><\/em><strong>\u202f<\/strong>\" to beneficiaries, including NGOs, associations, and international organisations. He also ordered the executive branch to submit a report by 18 February detailing the steps taken to comply with this injunction.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">Judges have been equally vigilant regarding other aspects of the current White House policy. Presidential decisions concerning gender affirmation for transgender youth and deferred dismissals of civil servants have cited reasons ranging from<strong> \"unconstitutionality\"<\/strong>to <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276959\/gov.uscourts.dcd.276959.1.0_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>the failure to comply<\/strong><\/a><strong> with essential administrative law procedures.<\/strong>.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">In the background, <strong>the separation of powers<\/strong> is at stake: many judges point out that the American Constitution is not a \u2018political game\u2019 that a president can play at will.<\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">The tug-of-war between Donald Trump and the judiciary illustrates the limits of executive power<strong>\u202f<\/strong>: <strong>the administration must take account of the constitutional legitimacy of its actions<\/strong>, or risk being continually hampered by emergency orders and temporary suspensions of its decrees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>","protected":false},"excerpt":{"rendered":"<p>Depuis sa r\u00e9\u00e9lection le 20 janvier 2025, Donald Trump multiplie les d\u00e9crets pr\u00e9sidentiels controvers\u00e9s, suscitant de vives r\u00e9actions tant aux \u00c9tats-Unis qu\u2019\u00e0 l\u2019international.
